Federal Judge Mandates Freedom of Abrego Garcia from ICE Custody
A federal judge has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement is without legal authority.
"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her ruling.
The case originates in a erroneous deportation to El Salvador earlier this year, which US authorities later acknowledged was an error. Following his repatriation to the United States to face human smuggling charges, he was held in immigration custody.
In her order, the judge noted that the government lacks a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."

The court proceedings involve conflicting assertions. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this allegation.
